Montana business name search
To see whether a business name is free in Montana, search it on the Secretary of State's Business Search at biz.sosmt.gov. Montana rejects names that are not "distinguishable" from names already on file, so look for close variations as well as exact matches. The office makes the final call when you file.
How to check if a name is available in Montana
- 01
Open Montana's Business Search
Go to biz.sosmt.gov/search and type the core words of your name, or a file number if you have one. Leave off LLC or Inc. so you see every entity that uses those words.
- 02
Use Advanced search for variations
Click "Advanced" to narrow by filing type or status. Then run the name again spelled differently, with abbreviations, and with or without punctuation. Montana says those small differences do not make two names distinct.
- 03
Check assumed business names too
Assumed business names (DBAs) sit in the same state database. A trade name that matches yours can still block your filing, so read every result, not just LLCs and corporations.
- 04
Look for federal trademarks
A clear state search doesn't mean nobody owns the brand. Search the USPTO trademark database at tmsearch.uspto.gov for registered and pending marks that look or sound like yours.
- 05
Confirm the web address and handles, or brainstorm more
See whether the .com and your main social handles are open before you commit. If Montana's search turns up too many near-matches, use our free business name generator at /business-name-generator/ to come up with alternatives.
Montana business naming rules
- A new name must be distinguishable from every name already registered or reserved with the Secretary of State.
- Adding or changing an abbreviation, punctuation, or an entity ending such as LLC or Inc. does not make a name different enough.
- A name can be refused for being too similar to an existing one, even when no exact match shows up in the search.
- An assumed business name must also be distinguishable from registered corporate, LLC, partnership and assumed names, and from trademarks and service marks on file with the office.
Reserving a name
Montana holds a reserved name for 120 days from filing, and the reservation can't be renewed. Check the current fee on the Secretary of State's site before you file.
DBAs and trade names
Assumed business names are registered with the Montana Secretary of State, not with counties. Sole proprietors, partnerships, corporations and LLCs all use the same state filing.

Frequently asked questions
How do I check if a business name is taken in Montana?
Search it on biz.sosmt.gov. Try the main words alone, with abbreviations and without punctuation, because the Secretary of State compares names on whether they are distinguishable, not on exact spelling.
Why did Montana say my name is unavailable when I couldn't find a match?
The office treats names that differ only by abbreviations, punctuation or an ending like LLC as the same. A close variation already on file is enough to block yours.
Where do I file a DBA in Montana?
With the Secretary of State as an assumed business name. Montana doesn't use county DBA filings.
Can I hold a Montana name before I form my LLC?
Yes. A name reservation holds it for 120 days and can't be renewed. Check the current fee on the Secretary of State's site.
General information, not legal advice. Name approval is decided by the Montana Secretary of State; a name showing as available in a search is not a guarantee it will be accepted.
